Welcome to Sweet Tooth at OWA (“Sweet Tooth,” “we,” “us,” or “our”). By accessing or using our website, placing an order, or interacting with our online services, you agree to the following Terms & Conditions. Please read them carefully before making a purchase.


1. General Use of Our Website

By using the Sweet Tooth online store, you confirm that you are:

  • Providing accurate, complete information when creating an account or placing orders.

  • Using the website only for lawful purposes.

  • We may limit or cancel quantities purchased per person, household, or order.

  • You authorize us or our payment processor to charge your selected payment method for the full order amount, plus applicable taxes and shipping.

We accept major credit cards and other methods listed at checkout.
Sweet Tooth does not store full credit card information.


4. Order Processing & Shipping

  • Orders are typically processed within 1–3 business days, excluding holidays.

  • Shipping times vary depending on carrier, weather, and destination.

  • Sweet Tooth is not responsible for delays once the package is in the carrier’s possession.

Meltable Products (Important)

Many of our items—especially chocolates and candy-coated products—are heat sensitive.
During warm weather, Sweet Tooth is not responsible for melting, damage, or texture changes caused by carrier transit.


5. Local Pickup (If Offered)

If you choose local pickup:

  • You will receive a confirmation when your order is ready.

  • Orders not picked up within 7 days may be restocked without refund.


6. Returns, Refunds & Exchanges

Because most candy and food items are perishable, all sales are final.

We do not accept returns or exchanges unless:

  • You received the wrong product, or

  • The product was damaged upon arrival (not due to heat).

To request assistance:

  • Contact us within 48 hours of delivery with your order number and clear photos of the issue.

  • Approved refunds will be issued to the original payment method.

We reserve the right to deny refund requests that do not meet policy requirements.


7. Gift Cards & Promotions

  • Gift cards are non-refundable, non-transferable, and cannot be redeemed for cash except where required by law.

  • Promotional codes cannot be combined unless explicitly stated.

  • Sweet Tooth is not responsible for lost, stolen, or unauthorized gift card use.


8. Intellectual Property

All website content—including images, product designs, logos, branding elements, copy, and graphics—is the property of Sweet Tooth at OWA or our licensors.

  • Delays caused by carriers or incorrect shipping information.

Our total liability shall not exceed the amount you paid for the order in question.

You agree to indemnify, defend, and hold harmless Sweet Tooth at OWA, OWA Parks & Resort, and all affiliated owners, officers, employees, agents, contractors, and representatives from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  1. Your use of our website or online services;

  2. Your purchase, receipt, handling, storage, sharing, or consumption of any Sweet Tooth products;

  3. Any allergic reaction, food sensitivity, illness, injury, or other adverse physical or medical condition connected to the ingredients, manufacturing, handling, or consumption of products;

  4. Any issues related to meltable or perishable items, including damage or quality changes due to heat or carrier transit;

  5. Your violation of these Terms & Conditions; or

  6. Your violation of any applicable law or the rights of a third party.

This indemnification expressly includes—to the fullest extent permitted by law—any claims involving serious injury, illness, allergic or anaphylactic reaction, or other severe adverse medical outcome, including those that may be life-threatening.


13. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.
Any disputes will be resolved in courts located in Baldwin County, Alabama.
